Notice of Violation
Measure taken by environmental inspectors in relation to a possible crime against natural heritage committed by individuals or legal entities.Notices of Violation are a procedure provided for in the Environmental Crimes Law (9,605/1998). They can be carried out by police officers or inspectors at the federal, state and municipal levels in view of a possible violation of environmental legislation committed by individuals or legal entities. Notices of Violation usually precede the issuance of fines for environmental crimes; these can also be challenged administratively or judicially. At the national level, the historical average of payment of fines applied by Ibama is only 3.3%.
